Under Section 4 of the 2000 Act, development carried out by a planning authority in its own functional area is not subject to the requirement to seek planning permission. However, it is important that the public is consulted about development which will have a material effect on the proper planning and sustainable development of an area, because of its likely size or because of its effect on its surroundings.
